Pam and I have recorded a Webinar for the Law Society of Scotland in which we set out the theories that underpin modern commercial mediation and in which we set out what we actually do when we practice in commercial mediation as mediators. Understanding the theories will help you understand why mediators do what they do and how commercial mediation actually works in practice. It will help you prepare yourself as lawyers and also help you prepare your clients, to undertake negotiations in legal disputes using commercial mediation as a fast and effective way to assist your clients in resolution. The Law Society of Scotland will be making this available shortly through its new Learning Management System and I will bring you details of that and the availability of the webinar shortly.

In the meantime, I’m also delighted to be able to advise you that Pamela Lyall and I will be leading an all-day seminar on Commercial Mediation Training and this will take place at the Law Society of Scotland offices in Edinburgh on 23 September 2019 from 8:30 AM until 4 PM. We will be looking at different models of mediation and how they are applied. We will be explaining how mediation can be used in practice to ensure positive outcomes for clients. We will consider insights from neuroscience into understanding human conflict and look at how these manifest themselves in the form of key social biases and conflict behaviours that can lead to disputes and make them worse. To counteract these, we will seek to help you develop the knowledge, skills and confidence in how to conduct yourself in a mediation session. This course marries theory with practice and is about learning by doing. You’re going to need lots of mental energy so bring some bananas!
